“sltgo” Wi-Fi ACCESS SERVICE TERMS & CONDITIONS

Welcome to our “sltgo” Wi-Fi Access Service Terms & Conditions (“T&C”). This document informs you about the terms and conditions applicable to the “sltgo” Wi-Fi Access service (“Service”) provided by Sri Lanka Telecom PLC. Sri Lanka Telecom PLC is a company registered in Sri Lanka with company registration number PQ7 located at Lotus Road, Colombo 01, Sri Lanka.

1. DESCRIPTION OF THE SERVICE

The Service will allow you to access the internet via a Wi-Fi connection through the”sltgo” Wi-Fi service set identifier. In order to access to the Service, you must agree to abide by the rules and conditions set out in this T&C.

We may revoke the authorization to Wi-Fi access at any time, in that case, the Hotspots available to provide the Service shall not be accessible to provide the Service.

You will be responsible for the incorrect use of the Service. We do not in any way assume responsibility for any unauthorized or unlawful use of the Service.

By accessing the Service, these T&C and our Privacy Policy [please include other applicable policies if any] (hereinafter “Policies”) will automatically apply to you. Before accessing to the Service you shall, read, understand, and agree to these Policies. If you do not agree to these Policies, you shall not access the Service.

By accepting these T&C you guarantee that you are of legal age and have the legal capacity to enter into these Policies.

2. ACCESS TO THE SERVICE

In order to access to the Service you need to comply with the access requirements of the hotspot that you are connecting to, which may include a requirement to create an account and sign in, and to confirm that you have read, understood, and accept these T&C and any applicable law.

Our registration process may ask you for information, including but not limited to Sri Lanka Telecom PLC broadband username, your Sri Lanka Telecom PLC account number, your name, surname, email address and/or postal address. You must provide accurate and complete information. You must also keep the information that you provide up-to-date and confidential.

Any information or data collected or stored by us is subject to our Privacy Policy, described later in this document, or any other applicable policy.

3. SERVICE QUALITY

We endeavor to ensure that the Service is as useful and efficient as possible. For this reason, we reserve the right to make changes to the Service at any time and for any reason.

We are unable to provide any warranties as to the levels of connectivity or connection speed you will receive via your device. This may depend upon your agreement with Sri Lanka Telecom PLC and your device.

You acknowledge that the Service is provided on “as is” basis without warranty of any kind, including but not limited to the satisfactory quality of the Service and/or the proper application of the Service for any concrete purpose.

4. USE OF THE SERVICE

You agree and accept to use the Service only for lawful purposes. The Service is made available provided that:

You do not use the Service for anything unlawful, immoral or improper;
You do not use the Service in any way that creates damage or risk to our business, reputation, employees, subscribers, facilities, third parties or to the public generally.
You do not use the Service to transmit any material that, intentionally or unintentionally, violates any applicable local, state, national or international law, or any rule or regulations promulgated thereunder.
You do not use the Service to make offensive or nuisance communications in whatever form. Such usage includes posting, transmitting, uploading, downloading or otherwise facilitating any content that is unlawful, defamatory, threatening, a nuisance, obscene, hateful, abusive, harmful (including but not limited to viruses, corrupted files, or any other similar software or programs), a breach of privacy, or which is otherwise objectionable;
You do not use the Service to access or use content in a way that infringes the rights of others;
You do not resell any aspect of the Service, whether for profit or otherwise. You accept that your entitlement to use the Service is for your personal use only.
You do not use the Service to transmit any material that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party.
You do not use the Service to transmit or facilitate any unsolicited commercial email or unsolicited bulk email.

5. PAYMENT TERMS

Some hotspots may offer premium paid access passes. To purchase one of these access passes you will pay the corresponding amount for accessing to the Service.

The available rates and payment methods will be clearly communicated on the captive portal and specific information on the applicable taxes will be presented to the user during the purchase process.

We reserve the right to change, at any time, the prices, promotions, and/or discounts for the access to the Service. By continuing to use the Service after the price change takes effect, you accept the new price.

6. TERMINATION

We reserve the right to modify, suspend, discontinue or terminate the Service and these T&C at our sole discretion and we will not be liable to you or to any third party.

7. PRIVACY POLICY

Information we collect

Our registration process may ask you for information, including but not limited to Sri Lanka Telecom PLC broadband username, your Sri Lanka Telecom PLC account number, name, surname, email, postal address, e-mail address or password. You must provide accurate and complete information. You must also keep the information that you provide up-to-date and confidential.

We fully comply with the applicable personal data regulation regarding the storage and treatment of your personal information and we implement a variety of security measures to maintain the safety of your personal data.

The data filed is adequate, appropriate and does not exceed the scope and purpose that the Service provides.

Use of your personal information

Any of the information we collect from you may be used in one or more of the following ways:

To personalize and improve your experience while accessing to the Service.
To send commercial information.
To improve our website or our customer service.
To process transactions.
To respond to legal process (e.g. a court order or authority request), if we believe in good faith that it is necessary to do so; to comply with requirements of mandatory applicable law; to protect the safety of any person and to address fraud, security or technical issues.

Payment data

When you pay for accessing to the Service, your credit card number, PayPal information and/or any other financial data are collected and stored by third party payment processors that comply with the highest international standards. The use of your data by our invoicing service provider is subject to its privacy policies.

Third Parties Access

When you access the Service via a hotspot in a public location or a business venue, your contact information may be shared with the owner of that hotspot to enable him to know and engage their customers.

Third Party Sites

Our Privacy Policy does not apply to any other company or to any other company’s websites or services even if you access them through the Service.

If you disclose your personal information to other companies your information will be dealt with according to their privacy practices.

We therefore have no responsibility or liability for the contents and activities of these third party sites.

Rights related to your data

You can exercise your rights to access, amend, delete and contest the data you have provided. Should you wish to notify us in this respect, send us your written request to: GM/Product Development and Management, Lotus Road, P.O.Box 503, Colombo 1, Sri Lanka. Do not forget to clearly state the right you wish to exercise.

8. INTELLECTUAL PROPERTY RIGHTS

You accept that the Service and our symbols, logos and graphics are trademarks of our property and that all these elements as well as our right to this property are protected by intellectual property laws. You will observe the industrial and intellectual property rights, even after the termination of these Policies.

You agree that the Service may include proprietary content, information, and material that is protected by applicable intellectual property laws and that you will not use such content in any way whatsoever except for permitted use of the Service.

In light of the above, you agree not to reproduce, distribute, publish, communicate, modify, rent, lease, loan, sell, assign, copy, transfer or transmit the Service, to any third party or create derivative works based on the Service, and you shall not exploit the Service in any unauthorized way whatsoever, including but not limited to trespassing or burdening network capacity.

9. LIMITATION OF LIABILITY

The Service is offered by us using all available technical measures to satisfy the needs of our users.

We may make any changes, corrections or improvements to any information or content found on the Service, without granting any right to claim or indemnification, or recognition of liability whatsoever.

We do not assume liability for any damage, injury, or loss of any kind as a result of the use of the Service or Service’s availability or operations. Nevertheless, we shall take all necessary actions to reestablish our Service in the event of any technical failure.

We shall not be liable for any indirect, incidental or consequential damages including loss of profits or data, personal injury or property damages related to or resulting from the use of the Services. We shall only be liable under these Policies for losses, which are a reasonably foreseeable consequence of the relevant breach of contract up to a maximum amount of LKR 100,000.

We shall not be liable for your actions resulting from any unauthorized use, or access to the Service.

We shall not be liable for any intrusion or hack of any device that is accessing to the Service.

We shall not be responsible for any information or contents shared by using the Service and neither for any losses, damages, intrusions regarding such information or contents.

You are always responsible for the use you make of the Service. Therefore you agree and consent to indemnify the service provider or any third party for all damage caused due to your breach of these Policies, including but not limited to any privacy policy breach, publication of any inadequate or insidious content.

You agree not to use the Service to harass, abuse, stalk, threaten, defame, or otherwise infringe or violate the rights of any third party, and that we are not in any way liable for any such use by you, nor for any harassing, threatening, defamatory, offensive, or illegal messages or transmissions that you may receive as a result of the use of the Service.

10. NO WAIVER

Any failure by you to insist at any time upon the performance of any of the terms, provisions or undertakings contained in these T&C or to exercise any rights thereunder shall not constitute or be construed as a waiver to require the future performance of any such term, provision or undertaking.

11. SEVERABILIT

If any provision of these Policies is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed and the remainder of its provisions will continue in full force and effect as if these Policies had been executed with the invalid, illegal, or unenforceable provision omitted.

12. JURISDICTION AND LAW

These Policies are subject to the laws of Sri Lanka, without regard to choice or conflicts of law principles and the parties hereby agree to submit to the exclusive jurisdiction of high courts of the Western Province Sri Lanka.
